5.6 The Trials / Les procès

The Trials

The trials are recorded and broadcasted by the offline official media if they result in a conviction. If the victims do not ask for justified anonymity or the victim is not a living child the results are broadcasted by the official media.

The audio/video footage is viewed at the courthouse by the Justice committees, the litigants and their defence. These sequences are taken into account in the form of written reports. Exceptionally, they are presented in their audio/video form; in this case the non-trial people who appear in the videos are blurred.

The litigant is defended by at least one lawyer. They can be defended by three people, possibly more if the case is very complicated.

The president of the Justice committee directs the trial. She (he) can be helped or replaced for the debates, by a lawyer or a person of her (his) choice who. This person has the right to deliberate only under her (his) his direction.

The litigant has the right to two trials by two Justice committees. The committees are completely independent of each other. The second court should not be aware of the deliberations and decisions of the first court.

The litigant should not be known to his judges. The judges who know the litigant are replaced.

If the conclusions of the two courts are concordant, the litigant can choose the sanctions decided by one or the other of these two courts. In the case of flagrant discrepancy between the two judgments on the guilt or the degree of guilt, the litigant must be retried by two courts, at the latest 10 days after the original trials. And so on and so forth until both judgments are the same.

Appeals or Trials on Appeal

If a new element appears after the judgment, this element should significantly modify the judgment already rendered. The litigant or Utopia (through its investigation and justice committees) may request further investigation.

If the findings of the new Investigations committee are likely to change the judgment, there will be a new judgment with the appointment of two new Justice committees. The litigant can appeal to the Wellbeing committee or for serious crimes against the people n ° 1, 2, 3 to the Ethics committee.

Recouses concerning sanctions

The litigant may request a review of the sanctions if there are too many differences between those presented by the two Justice committees. In this case the two committees and the convicted person are gathered to review the sanctions pronounced.
